The Committee recommends that local jurisdictions study their existing zoning codes, as well as other local ordinances addressing health, safety and the environment. The Committee has determined that the issues raised by oil and gas development, including horizontal fracturing, are not unique to this technology. Rather, the impact of oil and gas development, especially that employing horizontal wells and hydraulic fracturing merely brings into focus the needs of local jurisdictions to update their ordinances to reflect and address new industries, new technologies, and new demands on land use. Furthermore, as a result of its research, the Committee recognizes that each local jurisdiction is unique in terms of its land use, population density, and local environment, and so there is no single legislative approach to address these land-use issues.
